Xpirient Affiliate Program Terms & Conditions

Welcome to the Xpirient Affiliate Program. We are thrilled to invite you to represent a brand built on elevated experiences, meaningful connections, and the belief that time is the ultimate luxury.
These Terms and Conditions ("Agreement") govern your participation as an Affiliate ("Affiliate," "you," or "your") in the Xpirient Affiliate Program ("Program"). By enrolling in the Program, you agree to these terms, which establish a relationship based on integrity, professionalism, and mutual success.
Please read this Agreement carefully. It outlines your rights, responsibilities, and the standards we uphold to ensure the Xpirient brand remains synonymous with trust and quality.
1. Enrollment & Eligibility
To become an Xpirient Affiliate, you must submit a complete Program application. We value quality over quantity and review applications to ensure alignment with our brand values.
Eligibility Requirements:
You must be at least 18 years of age.
You must have the legal authority to enter into this Agreement.
You must provide valid tax and banking information for commission payments.
You must agree to represent Xpirient in a manner consistent with our premium positioning—avoiding "hype," aggressive sales tactics, or misrepresentation.
Xpirient reserves the right to reject any application at our sole discretion. Upon acceptance, you will gain access to our Affiliate Portal, marketing assets, and tracking tools.
2. Affiliate Responsibilities & Code of Conduct
As an Xpirient Affiliate, you are an ambassador of our brand. We expect you to operate with the same "concierge-level confidence" we deliver to our members.
You agree to:
Represent with Integrity: Promote Xpirient services truthfully and accurately. Focus on the value of Elite Xpiriences, time savings, and curated travel.
Maintain Professionalism: Conduct all business in a manner that reflects positively on Xpirient. Avoid spam, unsolicited heavy marketing, or behavior that could damage our reputation.
Disclose Your Status: Clearly state your relationship with Xpirient in all promotions (e.g., "Xpirient Affiliate" or "Ambassador") in compliance with FTC guidelines or relevant local laws.
Keep Information Current: Ensure your contact and payment information is always up to date in the Affiliate Portal.
3. Prohibited Activities
To protect the exclusivity and reputation of our community, the following activities are strictly prohibited and may result in immediate termination:
Misleading Claims: You may not make income guarantees or promise specific financial results to potential new Affiliates.
Discount Marketing: You may not market Xpirient using terms like "cheap," "discount," "bargain basement," or other language that devalues the premium nature of our service.
Brand Bidding: You may not purchase ads on search engines (PPC) that bid on the keyword "Xpirient" or any misspellings/variations thereof without prior written consent.
Spamming: Sending unsolicited bulk emails or messages is strictly forbidden.
Cookie Stuffing: You may not use invisible methods to set affiliate cookies.
Direct Vendor Contact: Affiliates may not contact Xpirient's vendors or partners—including but not limited to hotels, resorts, cruise lines, or tour providers—directly for any reason.
False Representation: Affiliates are strictly prohibited from representing themselves as employees of Xpirient, or from speaking on behalf of Xpirient in any official or unofficial capacity.
Executive Relationship Claims: Affiliates may not claim or imply special relationships or access to Xpirient executives or decision-makers.
Earnings Disclosure: Affiliates are not permitted to publicize their affiliate earnings on public forums, including but not limited to social media, blogs, or email marketing.
Income Claims: Affiliates may not make income claims—explicit or implied—when discussing the affiliate program in any medium.
Misleading Claims: You may not make income guarantees or promise specific financial results to potential new Affiliates.
4. Commissions & Payment Structure
We believe in rewarding you for the relationships you build and maintain. Our compensation model is designed to support long-term partnerships.
Commission Structure:
Referral Commissions: You will earn a commission for each qualifying membership sale completed through your unique affiliate link.
Recurring Revenue: You are eligible to earn recurring commissions on membership renewals and monthly/annual dues, provided the referred member remains active and in good standing.
Tiers & Bonuses: Specific commission rates and potential performance bonuses are detailed in the Affiliate Portal and are subject to change with notice.
Payment Terms:
Schedule: Commissions are calculated monthly and paid out on the 15th of the following month.
Threshold: A minimum balance of $50 is required for payout. Balances below this amount will roll over to the next month.
Method: Payments are made via PayPal or direct deposit in some markets. Payout methods are subject to change.
Clawbacks: If a referred membership is refunded or cancelled within the initial [Insert Days, e.g., 30-day] window, the corresponding commission will be deducted from your future earnings.
5. Intellectual Property & Marketing Assets
We provide high-quality, curated assets to help you succeed.
License to Use: Xpirient grants you a non-exclusive, non-transferable, revocable license to use our logos, trademarks, and marketing materials solely for the purpose of promoting the Program.
Brand Standards: You must not alter our logos or brand assets in any way. All custom marketing materials created by you that utilize our IP must be approved by the Xpirient team prior to publication.
Ownership: Xpirient retains all rights, title, and interest in our intellectual property.
6. Confidentiality
During your participation in the Program, you may be exposed to confidential information regarding our business, strategies, and member data. You agree to keep all such information strictly confidential and not to disclose it to any third party or use it for any purpose other than participating in the Program.
7. Term & Termination
Term: This Agreement begins upon your acceptance into the Program and continues until terminated by either party.
Termination:
By You: You may terminate your participation at any time by giving written notice.
By Us: We may terminate this Agreement at any time, with or without cause, by giving written notice. Immediate termination may occur if you violate these Terms or engage in conduct detrimental to the Xpirient brand.
Upon termination, you must immediately cease all use of Xpirient trademarks and remove all affiliate links from your platforms. Outstanding commissions earned prior to termination will be paid in the next cycle, provided the termination was not due to fraudulent activity.
8. Limitation of Liability
Xpirient will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Agreement or the Program, even if we have been advised of the possibility of such damages.
9. Dispute Resolution
We aim to handle all relationships with fairness and ease. In the unlikely event of a dispute, both parties agree to first attempt to resolve the matter through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration in Collin County, Texas, rather than in court.
10. Agreement & Acknowledgment
By submitting your application and participating in the Xpirient Affiliate Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
